Article 1 – Definitions

In these terms and conditions, under:

  • Contractor: Klussenbedrijf Universal, trading as Sterk Stuukwerk, located at Waterlelie 26, 1991 GD Velserbroek, registered with the Chamber of Commerce under number 85845930.
  • Client any natural or legal person who enters into an agreement with the contractor.
  • Work activities all agreed plastering, painting, renovation, and finishing works, as well as all related works.

Article 2 – Applicability

  1. These terms and conditions apply to all offers, agreements, and work performed by Sterk Stuukwerk.
  2. Deviations from these terms are only valid if agreed upon in writing.
  3. Any general terms and conditions of the client are not applicable unless expressly agreed upon in writing.

Article 3 – Quotes and Agreement

  1. All quotations are non-binding and valid for 30 days, unless otherwise stated.
  2. An agreement is established as soon as the client has accepted the offer in writing or digitally.
  3. Apparent errors or mistakes in quotations do not bind Sterk Stuukwerk.
  4. Images, impressions, and examples are for illustrative purposes only.

Article 4 – Prices, Deposit, and Payment

  1. Unless otherwise agreed, a deposit of 30% of the quote amount.
  2. The remaining 70% serves within 14 days to be paid after the invoice date.
  3. In case of non-payment, the client shall be in default without notice and shall owe statutory interest.
  4. All reasonable judicial and extrajudicial collection costs shall be borne by the client.
  5. Sterk Stuukwerk reserves the right to suspend work if the advance payment is not received on time.

Article 5 – Execution of the Works

  1. Sterk Stuukwerk performs the work to the best of its knowledge, craftsmanship, and according to current standards.
  2. The given execution and delivery times are indicative and never fatal deadlines.
  3. Delay due to weather conditions, material shortages, illness, or other unforeseen circumstances does not entitle you to compensation.
  4. Slight differences in color, texture, and gloss that are inherent in hand-applied plaster are not considered defects.

Article 6 – Client Obligations

The client ensures that:

  • the workspace is accessible in a timely manner;
  • water and electricity are available;
  • the ground is suitable for the agreed-upon work;
  • Furniture and valuables have been removed or covered;
  • any necessary permits or approvals have been obtained.

Any damage or delay resulting from the failure to comply with these obligations will be at the client's expense.


Article 7 – Additional and Reduced Work

  1. Work not included in the quotation will be considered additional work.
  2. Extra work will be discussed in advance as much as possible and billed separately.
  3. If hidden defects or an unsound subsoil are found during the work, Sterk Stuukwerk may propose additional work before continuing the work.

Article 8 – Delivery and Complaints

  1. The work is deemed to be completed once the client has approved it or put it into use.
  2. Visible defects must be reported within 48 hours to be reported in writing upon completion.
  3. Complaints do not suspend the payment obligation.
  4. Sterk Stuukwerk is always given the opportunity to rectify a justified defect within a reasonable period.

Article 9 – Warranty

  1. Sterk Stuukwerk is responsible for the proper execution of the agreed-upon work.
  2. No warranty is provided for defects arising from:
    • settlement of buildings;
    • hair cracks;
    • moisture problems or leaks;
    • structural defects;
    • a tainted or contaminated subsoil;
    • inadequate ventilation or incorrect use.
  3. Normal wear and tear and slight variations in color or texture are not covered by the warranty.

Article 10 – Liability

  1. Sterk Stuukwerk's liability is limited to direct damages resulting from demonstrable shortcomings.
  2. Liability is limited to a maximum of the invoice amount of the relevant order or, if applicable, the amount paid out by the liability insurance.
  3. Sterk Stuukwerk is not liable for indirect damages, consequential damages, business damages, loss of profit, or immaterial damages.

Article 11 – Force Majeure

  1. Force majeure means any circumstance beyond the reasonable control of Sterk Stuukwerk that makes performance temporarily or permanently impossible.
  2. This includes, but is not limited to, illness, extreme weather conditions, strikes, material shortages, government measures, and supplier failures.
  3. During force majeure, obligations are suspended without giving rise to any right to compensation.

Article 12 – Use of Project Photos

Sterk Stuukwerk may use photos of completed work for its portfolio, website, and social media, provided that no recognizable personal data is visible in the photos or permission has been granted for their use. The client may object in writing beforehand to the use of such photos.


Article 13 – Privacy

Sterk Stuukwerk processes personal data exclusively for the execution of agreements, the preparation of quotes, and communication with clients. Processing takes place in accordance with applicable privacy legislation. More information can be found in the privacy statement at www.sterkstuukwerk.nl.


Article 14 – Applicable Law and Disputes

  1. Dutch law shall exclusively apply to all agreements.
  2. The parties shall endeavor to resolve disputes through mutual consultation first.
  3. If this proves impossible, disputes will be submitted to the competent Dutch court.
